Terms of Use
These Terms of Use ("Terms") govern your access to and use of the rekrutko.si marketing website ("Website") and the Rekrutko recruitment platform ("Platform"), collectively referred to as the "Service". The Service is operated by the individual behind the Rekrutko brand ("Rekrutko", "we", "us", "our").
By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. Definitions
The following definitions apply throughout these Terms:
- "Account" — a registered user account on the Platform.
- "Organization" — a workspace created on the Platform for managing recruitment activities.
- "Owner" — the primary administrator of the Organization, initially set up during onboarding or to whom ownership has been transferred. The Owner has full control over the Organization.
- "Admin" — an Organization member with administrative privileges, including the ability to manage jobs, candidates, and team members.
- "Member" — an Organization member with limited, reviewer-level access who can view and evaluate candidates on assigned jobs only.
- "Candidate" or "Applicant" — an individual who submits a job application through the Platform.
- "Job Posting" — a recruitment listing created and published by an Organization on the Platform.
- "Pipeline" — the configurable sequence of hiring stages through which candidates progress, such as Application Review, Interview, and Offer.
- "Evaluation" — a review, rating, decision, or feedback submitted by an Organization member about a Candidate.
- "Content" — any text, files, images, data, or other materials uploaded to or created on the Platform or Website.
2. Eligibility
To use the Service, you must:
- Be at least 16 years of age.
- Have the legal capacity to enter into a binding agreement.
- If acting on behalf of an organization or company, have the authority to bind that entity to these Terms.
By using the Service, you represent and warrant that you meet all of the above eligibility requirements.
3. Accounts and Security
3.1 Account Provisioning
Accounts on the Platform are provisioned by Rekrutko. When onboarding a new client, we create the Organization and an initial administrator Account. Additional team members gain access by accepting an invitation from an existing Organization Owner or Admin. There is no public self-registration.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your Account. You must notify us immediately at [email protected] if you suspect any unauthorized access to or use of your Account. We are not liable for any loss or damage resulting from unauthorized use of your Account.
3.3 One Account Per Person
Each Account is personal and non-transferable. You may not share your account credentials with others.
4. Organizations and Team Management
4.1 Organization Setup
Organizations are created by Rekrutko as part of the client onboarding process. Each Organization has an Owner — initially the administrator account set up during onboarding. Organization names and URL slugs must be unique across the Platform and must not infringe on the rights of others.
4.2 Roles and Permissions
Organizations support three distinct roles, each with different levels of access and control:
- Owner — has full control over the Organization, including the ability to manage all jobs, candidates, members, and settings. The Owner can transfer ownership to another member and delete the Organization entirely. There is exactly one Owner per Organization.
- Admin — can manage job postings, candidates, and invite or remove team members. Admins cannot delete the Organization or transfer ownership.
- Member — can view and evaluate candidates only on jobs to which they have been assigned. Members cannot manage job postings, team settings, or other members.
4.3 Invitations
Owners and Admins may invite users to join the Organization by email. The following rules apply to invitations:
- Invitations expire after 7 days from the date they are sent.
- Only one active invitation per email address per Organization is permitted at a time.
- Invitees must accept the invitation to join the Organization. An Account is created for them upon acceptance if they do not already have one.
4.4 Ownership Transfer
The Owner of an Organization may transfer ownership to another existing member of the Organization. Ownership transfer is irreversible once completed. Only the current Owner may initiate a transfer.
5. Job Postings
5.1 Creating and Publishing Jobs
Organization Owners and Admins may create job postings. Before a job can be published, it must include at minimum a job description, employment type, work mode, and at least one application form field. Published job postings are publicly accessible to anyone on the internet.
5.2 Job Statuses
Job postings can exist in one of the following states:
- Draft — visible only to Organization members. The job is not accepting applications.
- Published — publicly visible and actively accepting applications from candidates.
- Closed — no longer accepting new applications. Existing application data is retained.
- Archived — hidden from active views within the Organization. All associated data is retained.
5.3 Custom Application Forms
Organizations may define custom form fields for each job posting to collect additional information from candidates. Certain system fields are required on all application forms and cannot be removed: full name, email address, and CV upload. Organizations are solely responsible for ensuring that any custom form fields they create do not collect information in violation of applicable employment, privacy, or anti-discrimination laws.
6. Candidate Applications
6.1 Submitting Applications
Candidates may apply to published job postings without creating an Account on the Platform. Each candidate may submit only one application per job posting, identified by their email address. All applications require the candidate's full name, email address, and a CV in PDF format with a maximum file size of 3 MB.
6.2 Application Data
Application data, including form responses and uploaded CVs, is accessible to the Organization's authorized members, which includes Owners, Admins, and Members assigned to the relevant job. By submitting an application, candidates consent to their application data being reviewed and evaluated by the hiring Organization's team.
6.3 No Guarantee of Review
Submitting an application does not guarantee that it will be reviewed, that the candidate will be contacted, or that the position will be filled. The hiring Organization is solely responsible for managing its recruitment process and communicating with candidates.
7. Hiring Pipeline and Evaluations
7.1 Pipeline Steps
Organizations may configure hiring pipelines with built-in steps, including Application Review, Interview, Offer, and Reopen. Candidates are automatically enrolled in the pipeline upon submitting their application. Pipeline progression and candidate status management are the responsibility of the Organization.
7.2 Evaluations
Assigned reviewers may submit evaluations that include decisions, ratings, written feedback, and notes. Evaluations are subject to the following visibility rules:
- The reviewer can always view their own evaluation.
- Other reviewers assigned to the same step can view evaluations only after they have submitted their own evaluation for that step.
- Organization Admins and Owners can view all evaluations at all times.
- Evaluations are never visible to candidates.
Once a pipeline step is marked as completed, evaluations for that step are locked and cannot be modified.
8. Content and Intellectual Property
8.1 Your Content
You retain ownership of all Content you upload to the Platform, including job descriptions, form data, evaluations, and other materials. By uploading Content, you grant us a limited, non-exclusive, worldwide license to store, process, and display that Content solely as necessary to provide the Service. You represent and warrant that you have the right to upload and share any Content you submit.
8.2 Candidate Content
Candidates retain ownership of their application materials, including CVs, cover letters, and form responses. By submitting an application, candidates grant the hiring Organization a license to review, store, and process their application materials for recruitment purposes related to the specific job applied for.
8.3 Platform and Website Intellectual Property
The Platform and Website, including their design, source code, features, branding, text, images, graphics, and all other materials, are owned by Rekrutko and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.
9. Website Use
9.1 Marketing Website
These Terms also govern your use of the rekrutko.si marketing website. The Website is provided for informational purposes to describe the Platform, its features, and related services.
9.2 Website Content Ownership
All content on the Website, including text, images, illustrations, design elements, and page layouts, is owned by Rekrutko or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Website content without our prior written consent.
9.3 Third-Party Links
The Website may contain links to third-party websites or services. These links are provided for convenience only and do not constitute an endorsement, sponsorship, or recommendation by Rekrutko. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party websites at your own risk.
10. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Post fraudulent, misleading, or deceptive job listings.
- Collect or harvest candidate data for purposes unrelated to legitimate recruitment for the specific job to which the candidate applied.
- Discriminate against candidates in violation of applicable employment laws.
- Attempt to gain unauthorized access to other users' accounts, data, or systems.
- Interfere with or disrupt the Service, its servers, or its infrastructure.
- Upload malicious files, viruses, or harmful code.
- Use the Platform to send spam or unsolicited communications.
- Scrape, crawl, or use automated tools to access the Platform without our prior written permission.
- Reverse engineer, decompile, or attempt to extract the source code of the Platform.
- Circumvent access controls, rate limits, or security measures.
- Impersonate another person, organization, or entity.
- Use candidate information for any purpose other than evaluating their application for the specific job they applied to.
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions.
11. Embeddable Application Forms
Organizations may embed job application forms on their own websites using iframes provided by the Platform. Embedded application forms are subject to the same Terms as forms accessed directly on the Platform. Organizations that embed application forms are responsible for ensuring that their own website's privacy policy adequately discloses the use of the Rekrutko Platform and how candidate data is collected and processed through the embedded form.
12. Emails and Communications
12.1 Transactional Emails
The Platform sends emails strictly for transactional, service-related purposes, including:
- Organization invitations sent to invited email addresses.
- Interview scheduling notifications sent to candidates and reviewers.
These are functional communications necessary for the operation of the Service.
12.2 No Marketing Emails
We do not send marketing, promotional, or newsletter emails. There is no mailing list to subscribe to or unsubscribe from.
13. Data Handling
13.1 Privacy Policy
Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
13.2 Organization Responsibilities as Data Controllers
Organizations using the Platform to collect and process candidate data act as independent data controllers for that candidate data. As data controllers, Organizations are responsible for:
- Having a lawful basis for collecting and processing candidate data.
- Ensuring that custom form fields comply with applicable privacy and employment laws.
- Responding to candidate requests for data access, rectification, and deletion.
- Not collecting sensitive personal data (such as race, religion, health information, or political opinions) through custom form fields unless legally permitted and genuinely necessary.
- Complying with all applicable data protection regulations, including the General Data Protection Regulation (GDPR) where applicable.
13.3 Data Deletion
- Organization Owners may delete their Organization at any time, which permanently and irrevocably removes all associated data, including members, jobs, candidates, evaluations, and pipeline data.
- Deleting a job posting permanently removes all associated candidate applications, evaluations, and pipeline data.
- Candidates may request deletion of their application data by contacting the hiring Organization directly or by contacting us at [email protected].
14. Service Availability
14.1 No Uptime Guarantee
The Service is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Service. We may perform maintenance, updates, or changes that temporarily affect availability.
14.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. For material changes that significantly affect functionality, we will make reasonable efforts to notify active users in advance.
15. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or business interruption.
- We are not liable for any hiring decisions, candidate evaluations, or employment outcomes resulting from use of the Platform.
- Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or 100 EUR, whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless Rekrutko and its officers, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or the rights of any third party.
- Content you upload, publish, or otherwise make available through the Service.
- Your recruitment practices conducted through the Platform.
17. Termination
17.1 Termination by You
You may delete your Account at any time through the Platform. Organization Owners may delete their Organization at any time, which will permanently remove all associated data. Termination of your Account does not relieve you of any obligations incurred prior to termination.
17.2 Termination by Us
We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our reasonable discretion. We will make reasonable efforts to notify you before or at the time of termination, except in cases of severe or repeated violations. Upon termination, your right to use the Service ceases immediately.
18. Dispute Resolution
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions.
18.2 Jurisdiction
Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ljubljana, Slovenia.
18.3 Informal Resolution
Before initiating any formal legal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for a period of at least 30 days. Most disputes can be resolved through good-faith communication.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rekrutko regarding the Service and supersede all prior agreements, understandings, and communications.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Rekrutko to be effective.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
19.5 Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government actions, power outages, or infrastructure failures.
20. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the effective date at the top of this page.
- We will notify active users through the Platform or by email.
- Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
